Child Porn Charges in New Jersey Come With Steep Penalties

Posted by Joseph D. Lento | Mar 26, 2024 | 0 Comments

A Woodbine man is in the Cape May County Correctional Facility facing child pornography charges following an investigation by the Cape May County Prosecutor's Office, according to news reports. The probe of Charles Chapman, 31, began after the prosecutor's office received information from the National Center for Missing and Exploited Children that uncovered "an unidentified subject, subsequently identified as Chapman, possessed various images of Child Sexual Abuse Material (CSAM) via his cloud account."

Members of the prosecutor's office, the Department of Homeland Security Investigations/Atlantic City, and the New Jersey State Police executed a search warrant at Chapman's home, where they discovered that Chapman possessed/viewed the material. Police charged Chapman with one count of third-degree possession of child pornography. He faces up to five years in prison.

Child Pornography Charges in New Jersey

Child pornography is any type of visual content, such as photographs, films, videos, pictures, or images generated by computers, created through electronic, mechanical, or other methods, showcasing sexually explicit activities involving minors.

In New Jersey, offenses related to child pornography are generally prosecuted under child endangerment laws. These offenses are categorized into several levels, including indictable offenses, disorderly person offenses, and petty disorderly person offenses. Possession of photographs, videos, or other forms of child pornography is typically classified as a third-degree offense in New Jersey.

The repercussions are severe, with penalties including up to 5 years in prison and fines of up to $15,000. Those convicted of sexually-based offenses are often mandated to register as sex offenders and provide a DNA sample. Charges may be heightened in cases involving the creation, distribution, or transportation of child pornography material.

When you're facing charges of child pornography, the stakes couldn't be higher. These charges carry with them not only the prospect of severe legal penalties but also long-lasting personal and professional repercussions. The complexity and sensitivity of these cases demand a defense strategy that is both nuanced and aggressive. This is why the choice of your defense attorney should be made with the utmost care and consideration.

Not all defense attorneys have the specialized knowledge, experience, and resources required to effectively navigate the intricacies of child pornography cases. These cases often involve complicated legal issues, including the admissibility of digital evidence, the legality of search and seizure operations, and the interpretation of statutes in the rapidly evolving area of Internet law. An attorney without a deep understanding of these areas may overlook critical defenses or strategies that could significantly impact the outcome of your case.
