In the case of a typical first-time offense with a blood alcohol concentration (BAC) ranging from 0.08 percent to 0.10 percent, the possible consequences may encompass:

  • Significant financial penalties, including fines, fees, and surcharges
  • Suspension of the driver's license
  • A maximum of 30 days of incarceration
  • Compulsory installation of an ignition interlock device
  • Required participation in an Intoxicated Driving Program (IDP)

It's important to note that a BAC of 0.10 percent or higher, a history of DUI offenses, involvement in an accident, and other contributing factors can considerably increase the likelihood of a drunk driving arrest.

Ignition Interlock Devices

One of the most prominent revisions to the DWI law in New Jersey is the lessening of the license suspension penalty for first-time offenders, now mandated to be accompanied by the installation of an ignition interlock device. The recent DWI legislation also permits drivers to voluntarily install an ignition interlock device.

For each two days that the device is in place, the driver will earn a one-day credit towards their license suspension period, provided they possess a driver's license with the necessary notation. However, individuals who have been arrested for operating a motor vehicle while impaired by a narcotic are ineligible to use the interlock device.

Plea Bargaining

Previously, plea bargaining was not an option in these cases, but this restriction has been lifted.
