Restraining Orders Lead to Evictions in New Jersey

In New Jersey, requests for a restraining order (RO) are taken very seriously. ROs, also called protective orders, are intended to prevent harm by separating an alleged abuser from their alleged victim.

There are two steps in the RO process:

A Temporary Restraining Order (TRO)

A TRO is granted on an emergency basis for up to 10 days until a final hearing is held. The TRO and information about the final hearing date are served on the accused abuser.

A Final Restraining Order (FRO)

A judge conducts a final hearing at which a FRO may be granted.

ROs can be issued quickly and have far-reaching consequences. The terms of a protective order often include limitations on how the accused abuser communicates, when they see their children, and where they live.

Can I Be Evicted Because of a Restraining Order?

If a judge issues an RO, you must comply with its terms or risk criminal charges. ROs often have broad terms and conditions, such as limiting access to the home you share with your accuser.

If you live with your accuser, the RO may require you to leave your home immediately, effectively causing your eviction. Additionally, a judge can prohibit you from living in your home and require you to continue to pay the rent or the mortgage for the property.
