Teenager Arrested for Involvement In New Jersey Brush Fire

Mount Olive Police contend that an 18-year-old Flanders man is responsible for sparking a brush fire after throwing a lit firework from a vehicle. Local law enforcement explained that on the afternoon of October 21, 2024, an officer was dispatched to Flanders Road for the report of an active brush fire. Before the officer arrived, a passerby extinguished the fire, and a witness gave a statement explaining that a white vehicle was traveling down the road when the passenger threw a lit firework out of the window.

During the investigation, the vehicle was identified as a white Ford Fusion, and the passenger was identified as Anthony Harding. He arrived later at police headquarters to discuss the incident and was subsequently placed under arrest, charged with criminal mischief, and released pending a court hearing.

How New Jersey Approaches Criminal Mischief

In New Jersey, criminal mischief involves purposefully or knowingly damaging another person's property, which includes public property. The severity of the charge depends on the extent of the damage and the circumstances surrounding the incident. In the case of the Flanders defendant, police allege that throwing a lit firework that caused a brush fire meets those criteria.

Penalties for criminal mischief in New Jersey can vary widely and include fines, restitution to the property owner, probation, or even time behind bars. Nevertheless, the charge and punishment will depend on the dollar amount of the damage as follows:

  • Disorderly Persons Offense: Damage under $500 can result in up to six months in jail and fines up to $1,000.
  • Fourth-Degree Crime: Damage between $500 and $2,000 may lead to up to 18 months in prison and fines up to $10,000.
  • Third-Degree Crime: Damage exceeding $2,000 can result in 3 to 5 years in prison and fines up to $15,000.

Given that the brush fire could have caused extensive damage and endangered public safety, the charges could be more severe.
