New Jersey Store Owner Sentenced After Filming Employees in Bathroom

Posted by Joseph D. Lento | Nov 18, 2024 | 0 Comments

When individuals commit crimes on suspecting victims, the New Jersey criminal justice system hands down harsh punishments. Nevertheless, an experienced attorney could make all the difference in mitigating charges or sentencing stipulations. If you are charged with criminal activity in New Jersey, call the Lento Law Firm at 888-535-3686 or fill out our consultation form now.

Store Owner Invades Employees' Privacy

After pleading guilty to 10 counts of third-degree invasion of privacy and one count of possession of child pornography, 36-year-old Nicholas Zirpoli was sentenced to a year in jail and three years of probation. The former owner of Plato's Closet in Roxbury reportedly filmed his employees in the bathroom.

The Morris County Prosecutor's Office said 11 people were victimized between late 2022 and early 2023, some of whom were minors. Zirpoli is also ordered to refrain from contacting the victims or their families and continue to undergo psychotherapy.

How Does An Attorney Approach the Case?

In circumstances like those mentioned above, an attorney would meticulously analyze all evidence presented by the prosecution, the video footage allegedly collected, and witness statements. Scrutinizing the methods by which the evidence was obtained is key to identifying any weaknesses in the prosecution's case or inconsistencies with witness statements at the trial.

Protecting the defendant's constitutional rights during each stage of the trial is paramount. This would manifest in an attorney ensuring that all searches, seizures, and interrogations were lawful. An attorney also assists in maintaining impartial proceedings free from public bias, which can be challenging in cases that attract local media attention.

Moderating Sentencing Outcomes

In cases where overwhelming evidence against a defendant exists, an attorney can enter plea negotiations with prosecutors. This has the potential to reduce the charges sought or provide a pathway toward a more lenient sentence, which can involve the following steps:

  • Presenting Mitigating Factors: Introduce evidence of the defendant's lack of criminal history, family care issues, or willingness to undergo rehabilitation.
  • Petitioning for Alternative Sentencing: Advocate for options like probation, community service, or mandated counseling instead of incarceration.
  • Introducing Character Witnesses: Presenting testimonials from family, friends, or community members that attest to the defendant's character and potential for reform.

Appealing Convictions and Complying With Sentencing

An attorney's assistance extends beyond the trial itself. They can evaluate the possibility of appealing the conviction or sentence if the grounds exist, such as:

  • Legal errors from the prosecution
  • New evidence emerges
  • Bias toward either party

In circumstances where defendants have exhausted appeals and must serve their sentences, an attorney can help them comply with all court-ordered requirements. In the case mentioned before, some include registering as a sex offender and adhering to additional probation conditions.
