The Charges in New York
The indictment in the New York case accuses Dr. Paduch of abusing and assaulting a number of victims, including minors, in the course of providing them with what they believed was “necessary and appropriate medical treatment.” The indictment alleges that the doctor “claimed that he needed to touch victims in certain ways to provide medical treatment” but that instead “sexually abused and assaulted” the victims “for no legitimate purpose and for his own sexual gratification.”
He is charged with seven counts of Inducement to Travel to Engage in Unlawful Sexual Activity, which makes it a crime to persuade or entice someone to engage in “any sexual activity for which any person can be charged with a criminal offense.” Each of the alleged victims of these counts was a minor at the time they were allegedly induced by the doctor to travel to New York from “a state outside New York.” In each case, the doctor allegedly violated New York Penal Law Section 130.55, which prohibits sexual contact with another person without that person's consent. If convicted, the doctor faces up to 20 years in prison for each of these counts.
Dr. Paduch is also charged with six counts of Inducement of a Minor to Engage in an Unlawful Sexual Activity. This makes it a crime to induce someone under the age of 18 to engage in “any sexual activity” for which “any person can be charged with a criminal offense,” in this case, the same New York Penal Law section 130.55. A conviction on these counts can result in a sentence of at least 10 years in prison and up to life.
